My VR friend made a deal under the Kelly Lemon Act. Is there a tax on this amount?
If the trailer does not have lemons, the company will not be taxed if you return it to its original location. If the settlement gives you more than you lose, the rest of the profits will be taxed.
As other speakers have pointed out, sometimes court decisions and settlements are taxable - and sometimes not. A tax professional, such as a registered agent or accountant, can give you the best advice.
When your friend gets money to repair your car or a medical bill that is not taxable. If you have received other amounts, such as damages, interest or other damages, chances are you are liable to taxes.
Receipts are usually not taxable because they only return / convert the loss. Medical claims, such as medical expenses, are generally not taxed, nor are injury or illness claims. Unfair claims are not usually taxed.
Gray area is usually emotional stress, pain and judgment. The part of an action that is medically relevant and used for medical purposes is not taxed, while the part that is related to non-compliance or harassment is taxed. If you get 1099 from an insurance company that lists the full amount, you can write to them and ask for a break. If they do not respond or do not cooperate with you, be careful to keep track of all your medical expenses related to your income tax.
Please note that the return of lost wages will be taxed. The same applies to damages, business interventions, breaches of contract, anger, retirement agreements and even illegal discrimination.
(Please note that there are specific rules for legal fees in case of illegal discrimination ... ie legal fees may be deducted / compensated. You usually also pay tax on the amount of legal fees!)
